Articles, Video Updates, and News across all Regions are open to all Pro and Prime subscribers.
1. Terms of Use
1.1 Access to and use of YPulse.com (“Website”) is provided by YPulse Inc. (“YPulse,” “we,” or “our”) on the terms and conditions set out below. By accessing and using the Website, you agree to be bound by these terms. These terms may be updated periodically. and continued use of the Website constitutes acceptance of any changes. Where we make material changes to these Terms, we will provide reasonable notice (which may include posting a prominent notice on the Website or sending an email to registered users) prior to such changes taking effect. Continued use of the Website after the effective date of any changes constitutes your acceptance of the revised Terms.
1.2 If you purchase syndicated or bespoke services from us, then a separate services agreement between you and us will document the terms and conditions for those services. The Terms of Use will neither change nor limit your rights and obligations under your services agreement with us.
2. Use of the Website
2.1 You acknowledge that you shall use the Website only for lawful purposes, for your own personal or internal business use.
2.2 You are permitted to access the Site, including the written text, reports, graphics, data, images, illustrations, marks, logos, sound or video clips, photographs, and/or other works (singly or collectively, the “Content”) solely for your or your organization’s internal information purposes.
3. Use of AI-Powered Search and Insights
3.1 Our AI-powered search tool uses proprietary data collected over nearly 21 years to generate insights. The tool is powered by a generative AI system and outputs are AI-generated. In accordance with applicable law, including the EU AI Act (Regulation (EU) 2024/1689) where relevant, we disclose that this tool constitutes an AI system and that outputs are the product of automated processing rather than human authorship. While we strive for accuracy, AI-generated results are provided “as-is” without guarantees of completeness or correctness.
3.2 Users may not use the AI-generated content to train other AI models, scrape data, or reproduce proprietary insights for commercial use without our explicit permission. This prohibition includes the use of automated bots, crawlers, or AI-assisted tools to systematically extract or harvest content from the Website. YPulse reserves the right to implement technical measures to detect and prevent unauthorized scraping or automated access.
3.3 YPulse disclaims any liability arising from reliance on AI-generated insights. Clients should validate AI-generated outputs before making business decisions. AI-generated outputs should not be treated as a substitute for professional advice or human expert review. YPulse does not guarantee that outputs are free from inaccuracy, bias, or hallucination inherent to generative AI systems.
4. Intellectual Property Rights
4.1 All content, including AI-generated insights, remains the intellectual property of YPulse. Users may not copy, distribute, or use content beyond permitted business purposes.
4.2 You may download or copy the Content and other downloadable items displayed on the Services for your company’s use only, provided that you maintain all copyright and other notices contained in the Content and other downloadable items. Copying or storing of any Content for other than personal use is expressly prohibited without prior written permission.
4.3 Unauthorized reproduction, modification, or distribution of any AI-generated reports, analytics, or insights is strictly prohibited.
5. Service Availability and AI Limitations
5.1 We strive to maintain Website uptime but do not guarantee uninterrupted access due to technical issues, maintenance, or force majeure events.
5.2 AI-generated insights are based on historical data and algorithms; therefore, they may not fully reflect current trends or predictions. Users assume responsibility for interpreting AI outputs appropriately.
5.3 We may change, suspend or discontinue any aspect of the Services at any time, including the availability of any Services feature, database, or content. We may also impose limits on certain features and services or restrict your access to parts or all of the Services without notice or liability.
6. Liability and Indemnification
6.1 To the maximum extent permitted by applicable law, YPulse shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or in connection with your use of the Website, its content, or AI-powered features, including but not limited to damages resulting from reliance on AI-generated insights, data loss, loss of profits, or business interruption. Where liability cannot be excluded by law, YPulse’s total aggregate liability shall not exceed the greater of (a) the amount paid by you to YPulse in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars (USD $100).
6.2 Users agree to indemnify YPulse and its officers, directors, employees, and agents (“Indemnified Parties”) from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of or access to the Website; (b) your violation of these Terms; (c) misuse of AI-generated content, data breaches caused by user negligence, or violations of these Terms.
7. Breach of Website Terms & Conditions
7.1 If we determine that you have violated any of these Website Terms & Conditions, we may take appropriate action, including but not limited to:
Issuing a warning.
Immediate, temporary, or permanent suspension of access to our Website.
Legal action to recover any costs or damages incurred.
Reporting violations to law enforcement authorities as necessary.
7.2 YPulse is not liable for actions taken in response to breaches of these Terms, and we reserve the right to take any additional measures we deem appropriate.
8. Links to and from Other Websites
8.1 In all cases where our website contains links to other websites and resources provided by third parties, these links are provided for your information only and do not represent an endorsement. We have no control over the contents of those websites or resources and, as such, make no warranties or assertions as to their content, nor does YPulse have any liability in connection with any of them (including, but not limited to, liability arising out of any allegation that the content of any third-party site infringes any law or the rights of any person or is obscene, defamatory or scandalous).
9. Personal data
9.1 YPulse will be processing your personal data according to the General Data Protection Regulation (“GDPR”) and additional data protection laws. These include, where applicable, the California Consumer Privacy Act as amended by the California Privacy Rights Act (“CCPA/CPRA”), the UK General Data Protection Regulation (“UK GDPR”), and other applicable U.S. state privacy laws including but not limited to the Virginia Consumer Data Protection Act (“VCDPA”), the Colorado Privacy Act (“CPA”), the Texas Data Privacy and Security Act (“TDPSA”), and the New Jersey Data Protection Act (“NJDPA”). 10. Registration and Security
10.1 As part of the registration or account creation process, you will create login credentials by selecting a password and providing an e-mail address. You also can be requested to provide certain registration information, which must be accurate and updated. Each registration is for a single user only. You are not allowed to share your registration login credentials or give your login credentials to anyone else. We may cancel or suspend your access to the Services if you share your login credentials. You are responsible for maintaining the confidentiality of your password, which you will not have to reveal to any representative or agent of YPulse. You may not: (1) select or use the login credentials of another person with the intent to impersonate that person; (2) use login credentials in which another person has rights without such person’s authorization; or (3) use login credentials that we, in our sole discretion, deem offensive. Failure to comply with these requirements will constitute a breach of these Terms of Service, which may result in immediate suspense or termination of your account.You consent to receive notifications from us electronically to the e-mail address you provide to us. You agree that all notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. You agree that you have the ability to store such electronic communications such that they remain accessible to you in an unchanged form.
10.2 Please notify us at legal@YPulse.com of any known or suspected unauthorized use(s) of your account, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of your password or credit card information.
10.3 You are responsible for all usage or activity on your account with YPulse.com, including use of the account by any third party authorized by you to use your login credentials. Any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of your account, at our sole discretion, and we may refer you to appropriate law-enforcement agencies.
10.4 If your access to any Service has been provided by or through a third party (for example, your employer or an educational institution at which you are a student) (each, a “Client”), the Client may have provided us with information about you to enable us to provide you with access to the Services and distinguish you from other subscribers (such as your IP address, email address or name).
11. Governing Law and Dispute Resolution
11.1 These Terms are governed by the laws of the State of New York. Any disputes shall be resolved through arbitration or in the courts of New York State. Notwithstanding the foregoing, nothing in this clause shall limit the rights of consumers or data subjects under mandatory applicable laws of their country of residence, including EU/EEA or UK data protection legislation.
